By accessing and using the TryAngles website (the “Site”) and services (the “Services”), you (the “Client”) agree to the following terms and conditions (the “Terms”). 


1. Acceptance of Terms

We are TryAngles Design, doing business as TryAngles (“Tryangles,” “we,” “us,” or “our”), a digital design company trading from South Africa. We operate the website https://tryangles.co.za (the “Site”) through which we provide our services, (collectively, the “Services” which include the provision and use of the Website). The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use our Services.

By accessing our Site, you agree to comply with these Terms. If you disagree with any part, you may not use our Site or services. You can contact us by email at info@tryangles.co.za


2. Changes to Terms

We reserve the right, in sole discretion, to make changes or modifications to these Terms and Conditions from time to time. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change. Continued use of our Site after any changes signifies acceptance of the new Terms. 


3. Services

TryAngles provides digital design, graphic and web design, and content creation services. We reserve the right to modify or discontinue any services without prior notice. Please be advised that our Services are hosted in South Africa and governed by such law.

From time to time, other services may be required for the finalisation of a particular project. Where these services lie outside of our range, it will be the sole responsibility of the client to procure and implement such services according to personal preference. Where possible, we will provide recommendations.

Excluded, third party services may include but are not limited to the following:

  • Print/Production services (not provided in-house)
  • Premium photography/footage (where license fees or shoots are involved)
  • Web/Email Service Providers (to secure domains, web hosting, email accounts etc)
  • Software engineers (custom software development)
  • IT support (in-house server setup/maintenance)
  • Social Media accounts (creation/access of login information)

Our Services are offered as per the Service Level Agreement and Briefing document entered into and approved between both parties. Details of the SLA can be accessed in the navigation menu of the website.

4. User Obligations

By using the Site and Services, you represent and warrant that:

  • All information you submit will be true, accurate, current, and complete;
  • You have the legal capacity to comply with these Terms and that you are not a minor in the jurisdiction in which you reside;
  • You will not access the Services through automated or non-human means, whether through a bot, script or otherwise;
  • You will not use the Services for any illegal or unauthorised purpose; only for and in compliance with the law;
  • Your use of the Site and Services will not involve any conduct that may harm TryAngles, our Site, or other users. 

If you provide any information that is untrue, inaccurate or unlawful, we have the right to refuse any and all current or future use of the Site and Services (or any portion thereof).

 

 5. Intellectual Property and Ownership Rights

All content on this Site, including text, graphics, logos, images, and software, is owned by TryAngles or its licensors. These Terms do not grant you any intellectual property license or rights to the Services and the Website or any of its components, except to the limited extent that the work produced from the Services, and it’s payment thereof, specifically permits you lawful rights to use it. Unauthorised copying, sharing or use of any content on this Site is prohibited and protected by copyright law.

Unless otherwise indicated, the client shall be entitled to ownership and usage of their final artwork, content and/or website created through the Services, upon full payment of the Services provided at the agreed fee. Until such payment terms are met, artwork, content and/or website development will remain in ownership of TryAngles. The work produced through our Services may be used for personal or commercial purposes, only within lawful restrictions. 

The Terms and the work produced through the use of our Site and Services, does not automatically grant you any intellectual property licenses. It is the sole responsibility of the Client to register and secure IP, Trademark and Copyright ownership through the appropriate legal and/or affiliated channels. TryAngles will not be held responsible for the legal copyrighting or trademarking of any Client artwork, design, website or content; nor will we be held responsible if such legal requirement has already been registered by another person/business. Furthermore, by accepting these Terms, the Client acknowledges and solely accepts the lawful consequences regarding the infringement of copyright and trademark laws.


6. Privacy

Your use of our Site is also governed by our Privacy Policy, which details how we collect, use, and protect your information. By using our Site, you consent to the practices described in our Privacy Policy in line with the Protection of Personal Information Act (POPIA). The Privacy Policy can be accessed in the navigation menu of the website.


7. Limitation of Liability and Indemnification

In no event and to the fullest extent permitted by South African law, will TryAngles be held liable for any damages arising out of or related to your use of our Site or Services. This includes, but is not limited to, direct, indirect, incidental, exemplary and consequential damages. Furthermore, these Terms provide full indemnity from punitive measures arising from loss of data, loss of profit, loss of revenue or other damages arising from your use of the Services.

You agree to indemnify, defend, and hold harmless TryAngles and its affiliates, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of your use of our Site or Services or of your breach of these Terms, in accordance with South African law. 


8. Disclaimer of Warranties

Our Site and Services are provided “as is” and ‘as-available’ without any expressed or implied guarantees or warranties of any kind. You agree that the use of our Site and Services are at your sole risk. TryAngles disclaims all warranties in connection to our Site and Services, including without limitation, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.


9. Links to Third-Party Websites

Our Site may contain links to third-party websites, such as those of our clients and partners. We are not responsible for the content or privacy practices of those sites. Accessing and using third-party sites is at your own risk. 


10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts. 

 

 11. Termination

TryAngles reserves the right to terminate or suspend your access to our Site or services at our sole discretion, without notice, for any violation of these Terms or for any other valid reason.
